So you're saying someone with an older machine who uses the install disks that came with said machine to do a clean install of Snow Leopard, Lion, or Mountain Lion can't upgrade.? Of course they can. I’m not being pedantic with my argument to you, what you’ve been saying is actually incorrect. And if we're talking about Lion/Mountain Lion, it's OS X, pronounced "ten".
First, a bit of the pedantry - it's currently macOS, not Mac OS.
